不要等待 Filial+ 的告警 — 它不会替您拨打
1. Filial+ 不是医疗器械
Filial+ 是一款消费级生活辅助工具,帮助海外华人独生子女远程关注中国父母的日常状态。本服务:
- 未取得美国 FDA 510(k)、De Novo 或 PMA 批准
- 未取得欧盟 CE Mark 医疗器械标识(MDR (EU) 2017/745)
- 未取得中国 NMPA 医疗器械注册(任意级别)
- 未取得加拿大 Health Canada、英国 MHRA、日本 PMDA 任何认证
因此,本服务不构成医疗器械(Medical Device),不能用于诊断、治疗、缓解、预防、监测疾病。
2. Filial+ 不是医疗服务
- 不是远程医疗(telemedicine)平台
- 不雇佣医生、护士、药师等医疗专业人员
- 不提供医学建议(medical advice)
- 不与中国医院、社区卫生服务中心、医保系统对接
- 不能开药、不能调药、不能预约挂号、不能查询病历
3. 阈值告警仅为辅助提示
当 Filial+ 显示"高血压告警"、"低血糖告警"、"漏药告警"、"多日未打卡告警"时:
- 这些告警基于父母手动输入的数字与您(子女)设定的阈值触发
- 父母可能输错(少打了一位、单位混淆 mmol/L 与 mg/dL、把 5.6 输成 56)
- 家用血压计 / 血糖仪可能存在 ±10% 误差,且与就医时医生使用的设备不同
- 父母在打卡前刚走完楼梯、刚生气、刚吃完饭,都会显著影响读数
- 告警不构成医学诊断,更不构成"立即就医"或"无需就医"的判断
正确使用方式:看到告警 → 立刻打电话给父母确认 → 让父母重新测量并报数 → 必要时让父母去社区医院或专科医生处复测 → 由医生做诊断决定。
4. 数据准确性的责任在父母(输入方)
- 所有健康数据由父母手动输入,本服务不验证血压计 / 血糖仪本身的准确度
- 父母可能因视力、操作不熟、健忘、情绪等原因输入错误或跳过打卡
- 父母漏打卡不一定意味着身体出问题 — 可能是手机没电、网络问题、外出旅行
- 本服务不会因父母漏打卡而自动联系紧急联系人或拨打 120
5. 您(子女)应做的
- 发现异常告警 → 立即电话核实(不要 24 小时后才打)
- 父母慢病管理(高血压、糖尿病、心脏病)→ 必须由当地医生开处方与定期复诊,本服务仅作日常观察
- 父母新症状(胸痛、呼吸困难、晕厥、剧烈头痛、意识模糊、突发肢体无力)→ 立即拨打 120,不要等待打卡或告警
- 定期把 Filial+ 导出的 PDF 报告作为就诊辅助资料给父母的医生(仅供参考,非诊断结论)
- 设置紧急联系人(亲戚、邻居)— 这是 Filial+ 之外必须的安全网
6. 您(子女)不应做的
- 不要因 Filial+ 显示"今日血压正常"而放弃父母原定的就诊计划
- 不要因 Filial+ 没有告警就认为父母一定健康(敏感事件如跌倒、心梗本服务无法预测)
- 不要根据告警自行让父母停药、加药、改药 — 必须由医生决定
- 不要把本服务的数据视为"医学证据"提交给保险、法律、行政机构
- 不要等本服务"自动报警"— 本服务不会拨打 120 / 911
7. 第三方原因导致的延迟与失败
邮件 / 短信告警可能因以下原因延迟或失败,本服务不承担相应损失:
- 父母手机欠费、关机、信号不良
- 子女邮箱进垃圾箱、邮件服务商节流
- 运营商短信通道延迟或丢包
- 跨境网络中断、GFW 干扰
- 本服务自身故障(按 SLA 定义:99% 月度,超出按比例退费)
8. 适用人群与限制
- 本服务面向 18 岁以上的子女与 50 岁以上、具备完全行为能力的父母
- 不适用于:阿尔茨海默症晚期、严重认知障碍、不能自主使用手机的老人 — 这类情况需要专业护理服务
- 不适用于:术后早期、ICU 转出后、危重症患者 — 必须由医院或专业护理机构监护
- 不适用于:孕产妇、未成年人、精神类急性发作期患者
9. 责任划分
因父母身体状况引起的任何后果(包括但不限于:误诊、延迟就医、未就医、用药不当、急救延误),本服务不承担医疗责任。本服务仅承担因自身故障导致的服务费按比例退还(详见服务条款第 10 条)。
10. 同意确认
注册流程要求:创建 Filial+ 账户时,您必须在签到表单中主动勾选以下确认:

- ☐ 我理解 Filial+ 不是医疗器械,不替代医生与急救服务
- ☐ 我同意将父母健康数据跨境传输至美国(PIPL 第 38 条)
未勾选无法完成注册。每次重大条款变更后会要求重新勾选。

Please read carefully: This disclaimer defines what Filial+ does and does not do. In a life-or-death moment, this notice may be the difference between safety and tragedy.

Do NOT wait for a Filial+ alert — it will not dial for you
1. Filial+ is NOT a Medical Device
Filial+ is a consumer-grade lifestyle aid for overseas Chinese only-children to remotely follow their parents' daily status. The service:
- Has NOT received US FDA 510(k), De Novo, or PMA clearance
- Has NOT received EU CE Mark medical-device certification (MDR (EU) 2017/745)
- Has NOT received PRC NMPA medical-device registration (any class)
- Has NOT received Health Canada, UK MHRA, or Japan PMDA certification
Accordingly, the service is not a medical device, and cannot be used for the diagnosis, treatment, mitigation, prevention, or monitoring of disease.
2. Not a Medical Service
- NOT a telemedicine platform
- Does NOT employ doctors, nurses, or pharmacists
- Does NOT provide medical advice
- Does NOT integrate with hospitals, community clinics, or insurance systems
- CANNOT prescribe, adjust meds, schedule appointments, or query medical records
3. Threshold Alerts are Advisory Only
"High BP alert", "Low glucose alert", "Missed medication", "No check-in for several days" alerts:
- are triggered by parent-entered numbers against thresholds you (the child) configured
- parents may mistype (drop a digit, mix mmol/L vs mg/dL, type 56 instead of 5.6)
- home BP/glucose meters can be ±10% off and differ from clinical instruments
- readings can be skewed by recent activity, mood, or meals
- alerts do NOT constitute a diagnosis, nor a "go to ER" or "no need to go" decision
Correct use: See alert → call your parent immediately → ask them to re-measure → if needed, send them to a community clinic for a verified reading → let a physician decide.
4. Accuracy Depends on the Parent
- All health data is manually entered; the service does not validate meter accuracy
- Parents may err due to vision, dexterity, memory, or mood
- A missed check-in does NOT necessarily mean an emergency — battery dead, away from home, network
- The service does NOT auto-call emergency contacts or 120/911 on missed check-ins
5. What You (the Child) SHOULD Do
- See an abnormal alert → call immediately (do not wait 24 hours)
- Chronic disease (HTN, DM, cardiac) → local physician must prescribe and follow up; Filial+ is observation only
- New acute symptoms (chest pain, dyspnea, syncope, severe headache, confusion, sudden weakness) → call 120/911 immediately, do not wait for a check-in or alert
- Periodically share the PDF report with the parent's physician as aux material, not a diagnosis
- Maintain emergency contacts (relatives, neighbors) — a safety net outside Filial+
6. What You SHOULD NOT Do
- Don't cancel a planned visit because today's BP looks normal in Filial+
- Don't assume your parent is healthy because there is no alert (the service cannot predict falls or MI)
- Don't stop, add, or change meds based on alerts — only a physician decides
- Don't submit Filial+ data as "medical evidence" to insurers, courts, or agencies
- Don't wait for "auto-alarm" — the service will NOT dial 911/120
7. Third-Party Delivery Failures
- Parent phone out of credit, off, low signal
- Child email caught in spam, throttled by provider
- Carrier SMS delays or drops
- Cross-border network outages, GFW interference
- Service's own outages (per SLA: 99%/month, pro-rated refund beyond)
8. Population & Limitations
- For children 18+ and parents 50+ with full mental capacity
- NOT for: late-stage Alzheimer's, severe cognitive impairment, inability to use a phone — needs professional care
- NOT for: post-op early phase, post-ICU, critical patients — needs hospital monitoring
- NOT for: pregnancy, minors, acute psychiatric episodes
9. Liability Allocation
For any consequence arising from a parent's medical condition (misdiagnosis, delayed care, no care, wrong medication, delayed emergency response), the service bears no medical liability. Only pro-rated refund for service-side failures applies (see Terms §10).
10. Consent
Signup requires: tick all of the following at account creation:
- ☐ I have read and understand the Medical Disclaimer
- ☐ I understand Filial+ is not a medical device and does not replace doctors or emergency services
- ☐ I consent to cross-border transfer of parent health data to the United States (PIPL Art. 38)
Without these ticks, signup is blocked. Re-consent is required after material changes.
